Court Grants Olivier Martinez Restraining Order Against Halle Berry

A Los Angeles County judge granted actor Olivier Martinez a temporary restraining order against his ex-wife, Academy Award-winning actress Halle Berry, restricting her custody and visitation rights with their 12-year-old son, Maceo. The court decision, issued Thursday, temporarily alters the former couple’s previous joint custody arrangement, transferring temporary primary custody to Martinez and limiting Berry to court-ordered visitation two days a week and every other weekend.

Under the provisions of the emergency order, Berry is also required to maintain a distance of at least 100 yards from Martinez while the parties prepare for a full evidentiary hearing scheduled for October 16. According to an official news report published by Times of India, the legal intervention follows serious allegations of physical abuse made by Martinez regarding an incident at Berry’s home.

Court documents filed by Martinez detail an alleged confrontation that took place on September 26 while the child was playing a virtual reality game in his bedroom. Martinez claims Maceo called him asking to be picked up after Berry allegedly attacked the boy physically, jumped on him, and grabbed him around the neck.

In the emergency petition, Martinez further alleged a pattern of physical and verbal altercations, asserting that the Oscar winner’s actions caused him severe emotional distress and threatened their child’s physical welfare. Berry’s legal counsel strongly refuted the claims in court filings, describing Martinez’s declarations as entirely meritless, deliberately misleading, and intended to manipulate ongoing custody negotiations.

The sudden court ruling represents a sharp escalation in the long-running post-divorce litigation between the two actors, who married in 2013 and separated in 2015 before finalizing their divorce proceedings in 2023.

Prior to Thursday’s ruling, the former spouses had been operating under a co-parenting agreement that included court-mandated co-parenting therapy sessions. In addition to modifying the visitation schedule, the judge directed both parties to participate in confidential court mediation to address custody parameters before returning to court later this month, where a judge will evaluate.
