New York City Mayor Mamdani Backs Off Pledge to Arrest Netanyahu

New York City Mayor Zohran Mamdani acknowledged late Tuesday, July 21, 2026, that the city does not possess the independent legal authority to execute an International Criminal Court (ICC) arrest warrant against Israeli Prime Minister Benjamin Netanyahu.
The announcement marks a notable retreat from a prominent campaign pledge.

Throughout his mayoral run last year and in subsequent statements, Mamdani had vowed that his administration would utilize city police to detain Netanyahu if the Israeli leader visited New York City, such as for the upcoming United Nations General Assembly in September.

In a two-minute video shared on social media, Mamdani explained that his administration and legal department had thoroughly reviewed all available options under applicable law.

Absence of Authority: “My administration has reviewed every avenue available under applicable law to determine whether New York City could execute the International Criminal Court’s arrest warrant if Benjamin Netanyahu came here,” Mamdani stated. “It is clear that we do not have the independent legal authority to enforce this warrant.”
A Call to the Federal Government: While stepping back from direct municipal action, Mamdani challenged federal authorities to step in. “The federal government, however, does—and I call on them to join the ICC and execute this warrant,” he added.
Continued Condemnation: Despite conceding the city’s jurisdictional limits, Mamdani doubled down on his rhetoric, describing Netanyahu as a “war criminal” and asserting that he remains unwelcome in New York City.

The announcement follows intense legal and political scrutiny regarding the boundaries of municipal jurisdiction, foreign policy, and federal supremacy. Legal experts had widely noted that local enforcement would run counter to federal statutes protecting visiting foreign officials, and that neither the United States nor Israel is a party to the Rome Statute that established the ICC.

President Donald Trump weighed in prior to the announcement, stating firmly on social media that Netanyahu “will not be arrested, in any way, shape, or form, while in the United States of America”.

Meanwhile, Israeli officials sharply condemned Mamdani’s ongoing rhetoric. Israeli Ambassador to the United Nations Danny Danon posted online, “Zohran Mamdani, ENOUGH. Enough with the blood libels… You were elected to serve New Yorkers, not Hamas’ propaganda”.
