Caroline Pham Says CFTC Can Regulate Almost Everything Except Onions

Former Commodity Futures Trading Commission (CFTC) Acting Chair Caroline Pham stated on Monday that existing federal law grants the agency broad jurisdiction to oversee virtually all markets and commodities, noting that only a handful of specific items like onions and motion picture box office receipts are legally excluded.

Speaking on the regulatory scope of the agency, Pham emphasized that the Commodity Exchange Act provides a sufficiently robust and principles-based compliance framework capable of regulating digital assets and crypto derivatives without the immediate necessity of new legislation from Congress. According to an official news report published by Crypto Briefing, Pham explained that statutory definitions leave very few areas beyond federal commodity oversight.

Pham voiced strong backing for the agency’s recent proposed rulemaking initiatives targeting retail crypto trading and leveraged digital asset products. She characterized the proposed measures as crucial protections designed to safeguard everyday individual investors while boosting overall market liquidity and transparency.

The comments come as financial regulators continue writing updated rules governing leveraged retail derivatives and asset tokenization, with Pham highlighting that existing statutory authority already covers emerging markets ranging from artificial intelligence computing resources to tokenized financial securities.
