Judge Tony Graf found that Ballard’s extrajudicial comments to media outlets regarding the strength of the state’s evidence and the defendant’s guilt created a substantial likelihood of prejudicing the proceedings.
While the ruling marks a significant development in the high-profile case, Judge Graf denied a motion from the defense to remove the death penalty as a potential punishment for Robinson. The judge stated that such a sanction would be “grossly disproportionate” to the misconduct and would constitute an improper judicial intrusion into prosecutorial discretion. To address concerns about a potential impact on the jury pool, the court plans to expand the jury selection process, including the use of additional questionnaires and summons.
Robinson, 23, is charged with aggravated murder in connection with the September 10, 2025, shooting of Charlie Kirk at Utah Valley University. Prosecutors have indicated they intend to pursue the death penalty if a conviction is secured. The preliminary hearing for the case is scheduled to take place from July 6 to July 10, 2026.
