Under the terms of the deal, Bolton is expected to plead guilty to a single count of retaining classified information, a move that could allow him to avoid prison time entirely. As part of the agreement, Bolton has also committed to paying a $2.25 million fine.
The plea deal addresses a criminal case filed in October 2025, in which Bolton was originally charged with 18 counts of retaining or disseminating classified materials. Prosecutors alleged that Bolton, while preparing a memoir, shared “diary-like” notes containing sensitive information—classified in some instances as “top secret”—with family members. The indictment claimed these notes included details derived from intelligence briefings and meetings with foreign leaders, though the agreement reportedly does not allege any wrongdoing regarding the contents of the memoir that was ultimately published.
Bolton, who served as national security adviser during President Donald Trump’s first term before becoming a vocal critic of his administration, had initially pleaded not guilty to the charges. A rearraignment hearing is scheduled for June 26, 2026, in federal court in Greenbelt, Maryland, where the plea is expected to be formally entered. While the plea agreement caps any potential prison sentence at five years, the final determination of his punishment remains at the discretion of the presiding judge.
The case had moved slowly due to complex procedures regarding the handling of classified information in court proceedings. The prosecution of Bolton has been viewed by some as part of a broader trend of legal actions taken against high-profile critics of the current administration.
